How To File A Claim

IMPORTANT: Do NOT file the First Report of Injury Form (FROI) with the Virginia Workers’ Compensation Commission.

IT IS EXTREMELY CRITICAL THAT ALL ACCIDENTS BE REPORTED AS SOON AS POSSIBLE.


Please fill out the form legibly and make sure the person completing the report is authorized. Provide as much information as possible so that an accurate investigation of each claim can be conducted. This will ensure that an injured employee will receive the benefits to which he/she is entitled. On the other hand, those who are not eligible to receive benefits will be identified.

Where do I send medical bills after a claim has been filed?

How long until the injured employee will receive benefits?

In Virginia, there is a seven-day waiting period. Benefits would begin on the eighth day of disability. The initial seven-day waiting period is payable only after the disability exceeds 21 days.

What do I do if a provider calls me to authorize a referral and/or medical treatment?

Please refer the provider to the adjuster assigned to the claim.

What do I do if I feel a claim is questionable?

Why should I file a claim?

Anytime an employee has an accident that requires medical attention, or when in doubt, you should file a First Report to protect you as an employer and ensure statutory reporting requirements are met in a timely manner.

Can I monitor my company’s claims?

Yes. As a member employer, you have access through our online portal to your loss reports showing amounts paid for claims, earned premium to date, and your company’s loss ratio (losses/premium) to date. The service company will also quickly respond to any inquiry regarding a specific claim or claims in general, and can offer advice regarding any concerns you may have.

Reporting a Questionable Claim

The majority of workers’ compensation claims are compensable or covered claims. However, there is a small percentage of claims reported to employers as work-related injuries or events that qualify as questionable. If these claims are not handled properly, they can result in losses that will affect an employer’s reputation for many years to come.

What to Do

The Virginia Workers’ Compensation Commission can impose heavy penalties for failing to report a claim in a timely manner. Therefore, a First Report of Injury should be filed right away.

Filing a report does not create a compensable claim for the employee. Any information regarding the questionable nature of a claim needs to be presented at the same time the report is filed. This would include any evidence an employer discovered while investigating the claimed accident and employee, such as:

  • Written statements from witnesses and supervisors, along with their names and contact information
  • Any information about the employee regarding pre-existing medical conditions
  • Any recent problems with employer-employee relations
  • If appropriate, photographs of areas where a claimed accident may have occurred — these allow an adjuster to assess whether a claimed condition did or did not exist

Even if you don’t have investigative materials, you, as an employer, should flag the claim and indicate why you feel it is questionable.

Getting this information to an adjuster right away can be critical to completing a thorough review of the claim. If delayed, vital information could be lost. Along with this data, an adjuster will use his/her training and experience to gather additional documentation that may be needed in defense of the claim, should it be litigated. This could include statements from the claimant and potential witnesses, medical records, or additional physical evidence.
